What is a Lasting Power of Attorney?
A Lasting Power of Attorney or LPA is a cost-effective way of legally authorising someone, who you trust, to make decisions on your behalf in handling your property and financial affairs and/or your health and welfare decisions, if you lack capacity at some point of time in the future or, if you no longer wish to make financial decisions for yourself.
Why should I make a Lasting Power of Attorney now?
The case of TV presenter, Kate Garraway, when her husband became seriously ill and lost mental capacity due to COVID says it all about why you need an LPA! You can only make an LPA whilst you have mental capacity to do so,( even if you chose not to use it immediately).Once you lose capacity it is too late to create the document and the options then are for an application to be made to the Court of Protection, to allow someone to be appointed as a deputy to act on your behalf. This is a slow and costly process, over which you will have no control and can cause hardship to partners and close relatives in the meantime.
