What is a Will?
A Will is a legal document that gives directions regarding the management and distribution of your estate after death. It allows you to select who can manage your estate and the beneficiaries that you wish to inherit the estate. If you die without a Will in place, you are said to be ‘intestate’. In these circumstances, there are laws that govern who can manage your estate and inherit your estate and in what order, irrespective of your wishes.
A Single Will is a legal document created by an individual to outline how their estate (money, property, and other assets) should be distributed after their death. It specifies who inherits assets, names guardians for any dependent children, and may include other instructions, such as funeral wishes. It is designed for one person and is not connected to the wishes of a spouse, partner or another individual. These are suitable for: single, divorced or widowed; have no need for their estate planning to align with another person’s wishes; want complete independence in deciding how their assets will be distributed.
A Mirror Will is a pair of almost identical wills typically created by two people, often spouses or partners, to reflect each other’s wishes. In most cases, each person leaves their estate to the other in the event of their death and if both parties pass away, the assets are usually distributed to a mutually agreed-upon beneficiaries, such as children or other relatives. These are a practical choice for couples.

What is a Lasting Power of Attorney?
A Lasting Power of Attorney or LPA is a cost-effective way of legally authorising someone, who you trust, to make decisions on your behalf in handling your property and financial affairs and/or your health and welfare decisions, if you lack capacity at some point of time in the future or, if you no longer wish to make financial decisions for yourself.
Why should I make a Lasting Power of Attorney now?
The case of TV presenter, Kate Garraway, when her husband became seriously ill and lost mental capacity due to COVID says it all about why you need an LPA! You can only make an LPA whilst you have mental capacity to do so,( even if you chose not to use it immediately).Once you lose capacity it is too late to create the document and the options then are for an application to be made to the Court of Protection, to allow someone to be appointed as a deputy to act on your behalf. This is a slow and costly process, over which you will have no control and can cause hardship to partners and close relatives in the meantime.
