Mediation (Civil/Commercial)
Are you worried as a small business owner or provider of services or products with a dispute with a customer? Are you getting bad publicity because of a dispute? Do you want to stop the bad publicity? Legal action is not an option? You do not have the time, resources and or money for litigation which may not give you the outcome you desire?
If your response is ‘Yes’ to the above statement questions, then we can help you! We know you want to feel heard and understood! We know that you would rather build relationships, and gain referrals by word of mouth and surveys to promote your business.
We recommend that Mediation may be a good step to consider in resolving disputes without incurring bad publicity, broken relationships, time, cost and effort of legal proceedings.
Our mediation service will:
-
Assess whether the conflict is suitable for mediation
-
Communicate the terms of the mediation to all parties in advance
-
Give each party opportunity to speak and to respond, without interruption
-
Ensure focus of mediation sessions is listening
-
Facilitate discussion through questioning
-
Invite ideas from all parties
-
Summarise all points
-
Document a written agreement or action plan resulting from the discussion
During the COVID-19 pandemic Meditation is done remotely using an online platform that mimics the process of a face-to-face mediation. It is simple for parties to access using their existing IT infrastructure.
There are some significant advantages of remote mediation, such as savings on time, travel and venue hire which are reflected in the reduced fee, but it can also be particularly useful when relationships between parties are very poor, as there will be no contact in person.
For disputes where mediation will not be appropriate or effective, we can make recommendations for next steps and alternative options. Get in touch, we can be of service to you!
