BBX Terms and Conditions
In consideration of BBX Exchange Ltd. (“BBX”) granting an account on the BBX Trade Exchange to the Applicant, the Applicant(s) and the Guarantor(s) hereby acknowledge and agree that (the “Agreement”): (1) the BBX Trade Exchange is operated in accordance with the BBX Rules of the Trading Program (the “Rules”) which are available here: https://bbxuk.com/wp-content/uploads/documents/BBX-rules.pdf; (2) the Applicant(s) and the undersigned Guarantor(s) agree to adhere to and be bound by the Rules; and (3) the undersigned Guarantor(s) agree to jointly and severally guarantee the payment of all monies payable to BBX and its associated companies (such associated companies include, without limitation, BBX Management Limited) by the Applicant in accordance with this Agreement and the Rules (the “Guarantee”). The Guarantee shall be a continuing guarantee and shall remain in full force and effect until all liabilities of the Applicant (including, without limitation, any approved credit line) and reviewed credit line and credit loans are fully paid and satisfied. The Applicant and the undersigned Guarantor(s) shall indemnify and keep indemnified BBX and its associated companies against all debts, liabilities, claims, suits, demands, costs and expenses in any way arising from the Applicant’s failure to repay any outstanding, due and payable credit lines or other amounts owed by the Applicant to BBX and its associated companies from time to time (including, without limitation, any amounts owed in connection with any Staff Accounts that relate to the Applicant’s primary BBX account). The Applicant(s) and the Guarantor(s) agree to BBX and its associated companies: (A) obtaining a credit report containing personal credit information about the Applicant and/or Guarantor(s) either for the purpose of assessing the Account Application or for the purpose of collecting overdue payments from the Applicant and/or the Guarantor(s); (B) disclosing to a credit reference agency personal information about the Applicant’s dealings with BBX and its associated companies; and (C) disclosing personal information about the Applicant and/or Guarantor to any credit reference agency named in a report obtained in accordance with paragraph A and to BBX and its associated companies receiving information from any credit reference agency. BBX World PTE LTD (Company No: 202403220G) is the owner of the software and website pertaining to the operation of the BBX Trade Exchange and has issued a License agreement to BBX Exchange Ltd to manage the operations of the exchange in the United Kingdom and Ireland. BBX World PTE LTD is the proprietary owner of all intellectual property related to the international payment platform, including, but not limited to, the software, systems, and processes that support the platform’s operations. However, BBX retains ownership of the member information stored in the database, both in electronic and hard copy formats. Note: by signing the Account Application Form and Account Agreement and Guarantee, the Account Opening Fee (as defined in the Rules) will become payable on acceptance of the Applicant’s application by BBX and/or its associated companies. The Account Opening Fee and is non-refundable, including any part of it where payable by instalment (see Rule 15 of the Rules for further information).
